Terms of Service

Galerin is an artist discovery and support platform operated by Galerin Limited Liability Company(“Galerin”, “we”, “us”). It connects independent visual artists (“artists”) with people who want to support and collect their work (“collectors”) through made-to-order prints, curated drops, quarterly open calls, and commissioned works.

By creating an account, or by placing an order or commission request, you agree to these Terms of Service and acknowledge our Privacy Policy. Artists who enable payouts additionally agree to the Artist Payout Agreement, which prevails over these terms for payout-specific matters. If you do not agree, do not use the platform.

You must be at least 18 years old (or the age of majority where you live) to buy, sell, or commission work on Galerin. You must be at least 16 years old to create an account at all.

You are responsible for your account and everything done through it. Sign-in is by email link or a Google account; keep those credentials secure and tell us promptly at [email protected] if you believe your account has been compromised. You must provide accurate information and may hold only one account.

Artists keep full ownership and copyright of their work. Nothing on Galerin transfers copyright to us or to a collector unless the artist and collector expressly agree otherwise in writing.

By publishing a work, an artist grants Galerin a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and reasonably promote the work on and off the platform for the purpose of operating Galerin, and — for works available as prints — to transmit the image file to our print fulfillment partner solely to produce and ship prints that collectors have ordered. This license ends when the work is removed, except as needed to complete orders already placed and to keep records the law requires.

When you upload, you represent that the work is your own original creation, that you hold all rights needed to grant the license above, and that the work does not infringe anyone else’s rights.

Human-made policy

Galerin is a platform for human-made art. Uploading AI-generated or substantially AI-produced imagery is prohibited. We use automated detection and community reports to enforce this. Violations earn strikes; repeated or serious violations lead to removal of work, suspension of uploads, forfeiture of pending editorial placements, and account termination. We may decline or remove any work at our discretion.

Prints

A print is a physical, made-to-order reproduction. Buying a print gives you ownership of that physical object only — it does not give you copyright in the artwork, and it does not permit reproduction, scanning, or commercial use of the image.

Commissioned works and digital files

Unless the artist and collector agree otherwise in the commission thread before payment, a completed commission grants the collector a personal, non-commercial license to the delivered work: you may display it, print it for yourself, and use it privately. You may not resell the files, mint them, use them commercially, or claim authorship. The artist retains copyright and may show the work in their portfolio.

Prints are produced on demand by our fulfillment partner, Artelo, to the exact size, framing, and format you configure at checkout. Prints may be ordered unframed— the bare archival print, supplied with a border for framing — or framed in one of the frames offered for that size, under glass with an acid-free mat. Not every frame is produced at every size, so the options shown at checkout are the ones actually available for the work and size you have chosen. Stated production and delivery times (for example “ships in 5–7 days”) are good-faith estimates, not guarantees. Risk in the goods passes to you on delivery.

Because every print is made to your specification, orders cannot be cancelled or returned for change of mind once production has begun. If you are a consumer in the European Union or United Kingdom, you acknowledge that the statutory 14-day right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised (Article 16(c) of Directive 2011/83/EU and equivalent UK law).

This does not limit your statutory rights for faulty goods. If a print arrives damaged, defective, or materially different from what you ordered, contact us within 14 days of delivery with photographs and we will replace it or refund you in full, including shipping. EU and UK consumers additionally retain the full legal guarantee of conformity under their local law.

A commission begins with a collector’s request and becomes binding when both sides accept agreed terms (scope, dimensions or formats, price, deadline) and the collector pays. Payment is collected up front and held in escrow— the artist is not paid at that point. Escrowed funds are held by our payment processor, Stripe, pending release; “escrow” describes this hold-and-release flow, and Galerin is not a bank or licensed escrow agent.

• Delivery. The artist delivers the work through the platform (digital files, or shipment details for physical work).
• Review window. The collector then has seven (7) days to review. Accepting the delivery releases the escrowed funds to the artist immediately. If the collector does nothing, funds release automatically when the window ends.
• Disputes. Raising a dispute inside the window holds the funds while we review the commission thread, the agreed terms, and the delivered work. We may release funds to the artist, refund the collector in whole or in part, or propose a revision. Our determination of the escrowed funds is final, without limiting rights you have under applicable law.

If an artist fails to deliver by the agreed deadline and does not cure within a reasonable period after notice, the collector is entitled to a full refund of the escrowed amount. Because a commission is personalised work, the EU/UK right of withdrawal does not apply once the artist has begun work; for purely digital deliverables you expressly consent to performance beginning before any withdrawal period ends and acknowledge the right of withdrawal is lost once delivery is complete.

Payments are processed by Stripe. Galerin never stores your full card details. Prices are shown in US dollars; shipping and any applicable taxes are shown at checkout before you pay. You authorise us to charge your chosen payment method for the total shown.

For sales by artists, Galerin acts as the artist’s limited payment collection agent: your payment to Galerin fully discharges your payment obligation to the artist for that purchase.

Drops are curated releases with limited windows or edition sizes; availability is first-come. The Quarterly Open is a themed open call: one entry per artist, a blind community vote of one vote per member, and a winning work released as a limited numbered edition. Entries are held out of the public gallery while a call runs. We may disqualify entries that violate these terms (including the human-made policy) or that attempt to manipulate the vote, and we may adjust or re-run a vote affected by manipulation.

• No uploading work you did not create or lack rights to.
• No AI-generated imagery presented as human-made work.
• No harassment, hate, or sexually exploitative content; no unlawful content.
• No manipulating discovery, saves, votes, or editions through fake accounts or coordinated activity.
• No taking payment for platform transactions off-platform to avoid fees or escrow protections.
• No scraping, reverse engineering, or interfering with the service or its security.

We may remove content, restrict features, withhold pending editorial placements, or suspend or terminate accounts that violate these rules. Where practicable we will tell you what rule was violated, and you may reply to [email protected] to contest a decision.

If you believe work on Galerin infringes your copyright, send a notice to [email protected] identifying the work, the location on the platform, your contact details, a statement of good-faith belief, and a statement under penalty of perjury that you are authorised to act. We remove infringing content, notify the uploader (who may counter-notify), and terminate repeat infringers.

The platform depends on third parties: Stripe for payments and artist payouts, Artelo for print production and shipping, Supabase for our database, authentication, and file storage, Vercel for hosting and delivery, Cloudflare for image storage and delivery, and Resend for email. Their services are governed by their own terms, and the Privacy Policy describes what each one receives. We are not responsible for outages or failures of third-party services, though we will make reasonable efforts to remedy their effects on your orders.

The platform is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim implied warranties and are not liable for indirect or consequential losses, lost profits, or loss of data, and our total liability arising out of the service is limited to the greater of US$100 and the amounts you paid to Galerin in the twelve months before the claim.

Nothing in these terms limits liability that cannot be limited by law— including liability for death or personal injury caused by negligence, for fraud, or consumers’ mandatory statutory rights. If you are a consumer in the EU or UK, you retain all protections of the mandatory consumer law of your country of residence.

You will indemnify Galerin against third-party claims arising from content you upload in breach of your representations in Section 3.

You may close your account at any time; commissions in flight and orders in production complete under the terms in force when they were placed. We may modify these terms; for material changes we will give at least 14 days’ notice by email or in-product notice, and your continued use after the effective date is acceptance. Changes do not apply retroactively to orders already placed.

These terms are governed by the laws of the State of Texas, United States, and disputes will be resolved in the courts of that jurisdiction — except that if you are a consumer in the EU or UK you may bring proceedings in your country of residence, and mandatory local consumer law applies to you regardless of the choice above.
