Artist Payout Agreement

This agreement applies the moment you connect a payout account and sell through Galerin. It sits on top of the Terms of Service and governs the money: what we charge, when escrow releases, what happens on refunds, and what you promise about the work you sell.

The relationship

You sell your work as an independent artist. This agreement does not create employment, agency (except the narrow payment-collection agency below), partnership, or a joint venture. You decide what to publish, what commissions to accept, and how to price commissioned work within the platform’s flows.

For each sale, Galerin acts as your limited payment collection agent: we collect the buyer’s payment on your behalf, and the buyer’s payment to us discharges their debt to you. Our corresponding obligation is to pay out what you have earned under this agreement.

Stripe Connect

Payouts run exclusively through Stripe Connect. To enable payouts you must complete Stripe onboarding, which includes identity verification and providing bank details directly to Stripe, and you must accept the Stripe Connected Account Agreement. Keeping your Stripe account accurate and in good standing is your responsibility; we cannot release funds to an account Stripe has restricted, and Stripe’s own holds, reserve requirements, and payout schedules are outside our control.

You may disconnect your Stripe account at any time. Sales made while disconnected accrue on your ledger and are swept to you when you reconnect and verification completes.

When you are paid

Your payout is calculated and recorded on your ledger at the moment of sale, at the rate then in force. We transfer it to you tied to that sale’s payment, so it moves as soon as the collector’s card clears — normally about 2business days — after which Stripe pays it to your bank on your account’s schedule. End to end that is typically 2–5 business days from the sale. Your first payout takes longer, because Stripe applies a longer settlement window to a new account while it completes verification.

Commission funds are held until you deliver and then for the seven (7) days collector review window, as set out in Section 4, before this timeline begins.

These timings are estimates, not guarantees. Stripe’s settlement timing, verification holds, and reserve requirements are outside our control, as are your bank’s posting times. What we do commit to: a payout that cannot be sent stays recorded and owed to you on your ledger, it is retried automatically, and it is never forfeited for going unclaimed.

Your royalty and your bonus

Prints

For made-to-order prints your payout has two parts. The first is a royalty: a fixed percentage of the unframed list price of the size sold. It is guaranteed on every print sale, it does not vary with what production costs us, and it is the same amount whether the collector buys the print unframed or framed, in any frame we offer — a framed price recovers the cost of the frame and nothing more.

The second is a bonus: a share of what the sale earns beyond the royalty, production, shipping, and payment processing. The bonus rate is the largest you qualify for at the moment of sale, among:

  • the save-tier bonus — rising with total saves across your published works;
  • for the first two hundred artists on the platform, a permanent Founding Artist bonus floor that applies whenever it exceeds your save-tier bonus;
  • any higher rate Galerin has granted your account individually.

The current figures — your royalty percentage, what it pays at every size we sell, the full save-tier ladder, and the Founding Artist floor — are published on your Payouts page (the Payout Schedule) and form part of this agreement. The rates applied to a sale are those in effect at the moment of that sale. Your payout ledger records the sale price and your payout for every order; amounts are computed to the cent, with any sub-cent remainder retained by the platform.

In the rare case that a sale does not cover production, shipping, and payment processing — for instance where a cost changes between listing and fulfilment — your payout is limited to what the sale actually cleared, and Galerin absorbs the shortfall. This has never been reached at our published prices and is stated only so the arithmetic is complete.

Digital commissions

Commissions are not made-to-order prints and carry no production cost. A physical or platform-fulfilled commission is subject to a platform fee at the rate shown in the Payout Schedule; a digital commission carries no platform margin beyond a payment-processing fee that covers the card cost of moving the money, rounded up to the cent, so you keep nearly all of it.

We may change the royalty percentage, bonus rates, or commission fees prospectively with at least 30 days’ notice; a change applies only to sales made after it takes effect, and never worsens the permanent Founding Artist floor. List prices themselves may change at any time — your royalty is a percentage of the price in effect when the sale happens.

Print fulfillment and quality

By marking a work available for print, you license Galerin and its fulfillment partner Artelo to reproduce the work solely to produce and ship prints that buyers have ordered. You agree to supply files that meet the platform’s technical floor (currently RGB colour at no less than 150 DPI at the offered sizes, or 125 DPI for large-format sizes of 24 inches and above, which are viewed at distance; files below 250 DPI are enhanced by our print optimization, and every print is rendered at 300 DPI); the platform automatically limits offered sizes to what your file supports. Defective-print replacements are produced at no cost to you and do not reverse your payout; refunds for our or Artelo’s fulfillment failures are borne by us, not you.

Commissions, escrow, and delivery

When a collector pays for a commission, the funds are held in escrow — held by our payment processor, Stripe, pending release — and are not yours yet. They release to you when the collector accepts your delivery, or automatically seven (7) days after delivery if the collector does nothing. A dispute raised inside that window holds the funds until resolution as described in the Terms of Service.

You agree to deliver work matching the agreed brief by the agreed deadline, to communicate through the commission thread (which is the record we consult in a dispute), and not to move a platform-initiated commission off-platform to avoid fees or escrow. Failure to deliver entitles the collector to a refund of the escrowed amount.

Refunds, chargebacks, and reversals

If a sale is refunded or charged back after you were paid — because of a dispute outcome, a card chargeback, fraud, or a breach of your warranties — the corresponding payout is reversed. We may recover reversed amounts by offsetting them against your pending and future payouts and, where the law allows, by debiting your connected Stripe account. Your ledger shows every reversal. We do not reverse payouts for print defects that are our or Artelo’s responsibility.

We may withhold or delay payouts where reasonably necessary to investigate suspected fraud, vote manipulation, or a breach of this agreement, and will tell you why unless the law prevents it.

Taxes

You are responsible for your own taxes on your earnings, including income tax, self-employment tax, and any VAT or GST registration and remittance obligations that apply to you. Stripe issues tax forms (such as US Form 1099-K) where legally required. Galerin collects and remits sales taxes on transactions only where marketplace facilitator or equivalent laws require it to.

Your warranties

On every work you publish or deliver, you warrant that:

  • it is your own original, human-made creation — not AI-generated or substantially AI-produced;
  • you own or control all rights needed to sell it and to grant the licenses in this agreement and the Terms of Service;
  • it does not infringe any third party copyright, trademark, or rights of publicity or privacy;
  • any commissioned work is created for the commissioning collector and delivered per the agreed brief.

You will indemnify Galerin against third-party claims, and the reasonable costs of defending them, arising from a breach of these warranties. Breaches may also trigger payout reversal under Section 6 and account action under the Terms of Service.

Founding Artist program

The first two hundred artist accounts receive a permanent bonus floor on print sales — published in the Payout Schedule — and the Founding Artist badge. The floor is personal to your account: it survives rate changes but is not transferable and is forfeited if your account is terminated for breach. It sits on top of the same royalty every artist earns, which the floor does not change.

Term and ending the agreement

This agreement runs while you have payouts enabled or amounts on your ledger. You may stop selling at any time; we will still pay out amounts you have already earned, subject to Sections 5 and 6, and the record-keeping and reversal provisions survive. We may terminate for material breach; on termination for fraud or infringement we may withhold ledger amounts to the extent needed to cover reversals and claims.

This agreement is governed by the same law and forum as the Terms of Service (the State of Texas, United States). We may amend it prospectively with 30 days’ notice; continuing to sell after the effective date is acceptance. Questions: [email protected].
